Your privacy is important to us. This privacy statement explains the personal data POIST Systems™ LLC processes, how POIST Systems processes it, and for what purposes.

POIST Systems LLC offers a wide range of products, including MyPOIST™ a Personal Online Information Storage & Tracking system. MyPoist includes personal medical data tracking and storage, dependent medical data tracking and storage, pet data tracking and storage, hazardous material encounters tracking and storage, and home management tracking and data storage tools. References to POIST Systems LLC products in this statement include all services, websites, applications (apps), software, servers, and devices associated with POIST Systems.

Please read the product-specific details in this privacy statement, which provide additional relevant information. This statement applies to the interactions POIST Systems LLC has with you and all MyPOIST™ Systems LLC products.

Personal Data POIST Systems Collects.

POIST Systems collects data from you, through our interactions with you and through our products. You provide most of this data directly, and we get some of it by collecting the general data that you enter for the development of information tables. The data we collect depends on the context of your interactions with POIST Systems and the choices you make, including your privacy settings and the products and features you use. The tables we develop from your personal data populate drop-down menus and standardize terminology throughout our products.

You have choices when it comes to the technology you use and the data you share. If we ask you to provide personal data, you can decline. Most of our products require personal data to provide you with our services. If you choose not to provide the data required to provide you with a product or feature, the use of that product or feature will be significantly restricted. Likewise, where we need to collect personal data by law or to enter or carry out a contract with you, and you do not provide the data, we will not be able to enter into the contract; or if this relates to an existing product you’re using, we may have to suspend or cancel it. We will notify you if this is the case at the time. Where providing the data is optional, and you choose not to include personal data, features like personalization that use such data will not work for you and your historical records may be incomplete.

How POIST Systems Uses Personal Data

POIST Systems uses the data we collect to provide you with rich, interactive experiences. We use data to:

  • Provide you with access to your personal data at any time and from any Internet connected device.
  • Provide Emergency Services with your designated personal medical information via our emergency data sheets, QR codes, or phone emergency access links.
  • Provide you with a historical record and tracking of your, your dependents, and/or your pets, medical and/or hazardous encounters.
  • Provide generalized data (not linked directly to you, your dependents, or your pets) to third-party advocates for identifying and tracking of conditions that might require future legal advocacy including but not limited to; hazardous materials exposure, hazardous condition encounters, drug prescriptions, medical procedure encounters, medical equipment use, and other processes that may link to recalls, restitution, or concern.

We also use the data to operate our business, which includes analyzing our performance, enhancing cybersecurity, meeting our legal obligations, developing our workforce, and doing research.

In carrying out these business operations, we combine the data we collect from different contexts (for example, from you combined with thousands of other users of two or more POIST Systems products) or obtain from third parties to give you a more seamless, consistent, and personalized experience, to make informed business decisions, and for other legitimate purposes.

POIST Systems or any of its Products or Services does not lease, sell, or give away your personal data (except generalized data not linked to your name) to any third-party, non- POIST Systems business or organizations, or government entities.

Reasons POIST Systems Shares Personal Data

As previously stated, POIST Systems does not share any of your personal data with non- POIST Systems entities. POIST Systems does share your defined personal data with your consent to emergency medical personnel via an emergency data sheet, QR code or link as specifically authorized by you when you are setting up your emergency data/first responder code. We also share general collective data with POIST Systems-controlled advocates and subsidiaries; with legal entities working on our behalf; when required by law or to respond to a legal process; to protect our customers; to protect lives; to maintain the security of our products; and to protect the rights and property of POIST Systems and its customers.

Please note that, as defined under certain State data privacy laws, “sharing” also relates to providing personal data to third parties for personalized advertising purposes. POIST Systems does not share your personal data with third-party entities for any reason unless specifically authorized by you, the POIST Systems account holder.

Your POIST Systems™ Account

With a POIST Systems account, you can sign in to POIST Systems products, as well as those of select POIST Systems partners. Personal data associated with your POIST Systems account includes credentials, name and contact data, payment data, device and usage data, and information about your POIST Systems activities. Signing into your POIST Systems account enables personalization and consistent experiences across products and devices, permits you to use cloud data storage, allows you to make payments using payment instruments stored in your POIST Systems account, and enables other features.
There are two types of POIST Systems accounts:

  1. When you create your own POIST Systems™ account, the account is tied to your personal email address. We refer to that account as a Personal POIST Systems™ Account.
  2. When you authorize a third-party organization (such as an assisted living facility) to create your POIST Systems account as part of an organizational group, we refer to that account as an Organizational POIST Systems™ Account. In a group, your account may be tied to the email address provided by that organization with your personal information captured in subaccounts.

If you sign into a service offered by a third-party with your POIST Systems account, you will share with that third party the account data required by that service.e

How To Access and Control Your Personal Data

When setting up your account, you will make choices about the collection and use of your data by POIST Systems. You can control the personal data that POIST Systems has recorded and stored, and exercise your data protection rights, by contacting POIST Systems or using the various tools we provide. In some cases, your ability to access or control your personal data will be limited, as required, or permitted by applicable law. How you access or control your personal data will also depend on which products you use and what level of protection you choose. For example, you can:

  • Access and clear any of your data through the POIST Systems products.
  • Choose to leave non-required information fields blank.
  • Choose to ignore advocate postings on the home page.
  • Allow your subscription to expire. Your personal data will be purged one year from the expiration date.

Not all personal data processed by POIST Systems can be accessed or controlled via the tools above. If you want to access or control personal data processed by POIST Systems that is not available via the tools we provide or directly through the POIST Systems products you use, you can always contact POIST Systems via the contact information on our website, www.poistsystems.com.

Cookies and Similar Technologies

Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the cookie. The MyPOIST™ system does not use cookies or similar technologies for any reason.

POIST Systems Products and Services may use in-house developed tools to tabulate website, webpage, and/or application usage data, identify recurring data entry errors, identify possible data security threats, and/or determine future usefulness of various aspects of our products and services.

For third-party products used within POIST Systems products, you have a variety of tools to control the data collected by cookies, web beacons, and similar technologies. For example, you can use controls in your Internet browser to limit how the websites you visit are able to use cookies and to withdraw your consent by clearing or blocking cookies.

Organization Provided POIST Systems Products

Most POIST Systems products are intended for use by individuals; however, organizations, such as assisted living facilities, may provide POIST Systems products as part of their resident support plan. If your organization provides you with access to POIST Systems products, your use of the POIST Systems products is subject to your organization's policies, if any. You should direct your privacy inquiries, including any requests to exercise your data protection rights, to your organization’s administrator. When you use the features in POIST Systems products within an organization’s account, other users in your network may see some of your activity.
If you use a POIST Systems product with an account provided by an organization you are affiliated with, that organization can:

  • Control and administer your POIST Systems product and product account, including controlling privacy-related settings of the product or product account.
  • Access and process your data, including your emergency medical data, medical history data, and the contents of your personal files associated with your POIST Systems product and product accounts.

If you lose access to your organization account (in event of change of assisted living residence, for example), you may lose access to products and the content associated with those products, including those you acquired on your own behalf, if you used your organizations account to sign into such products. Notify POIST Systems immediately if you change organizations and need to establish a personal account or to transfer your data to another organization’s account.

When you use a POIST Systems product provided by an organization, POIST System’s processing of your personal data in connection with that product is governed by a contract between POIST Systems and your organization. POIST Systems processes your personal data to provide the product to your organization and you. If you have questions about POIST System’s processing of your personal data in connection with providing products to your organization, please contact your organization. If you have questions about POIST System’s business operations in connection with providing products to your organization as provided in the Product Terms, please contact POIST Systems as described in the Contact section of our website.

For POIST Systems products provided by your organization, POIST Systems will:

  • not collect or use personal data beyond that needed for authorized medical tracking or reporting purposes.
  • not sell, lease, or give-away personal data.
  • not use or share personal data for advertising or similar commercial purposes, such as behavioral targeting of advertisements to residents.
  • not build a personal profile of a resident, other than for supporting authorized medical tracking purposes or as authorized by the organization.
  • require that our advocates, with whom general data is shared, are obligated to implement these same commitments for resident personal data.

POIST Systems™ Collection of Children’s Personal Data

Due to child protection protocols within the POIST Systems Products and Services, persons under the age of eighteen (18) are not authorized to subscribe to any POIST Systems Products or Services. Persons under the age of eighteen will require a parent or legal guardian to open a personal account with the person under eighteen years of age added as a dependent in the optional MyDependentTracker application.

POIST Systems products that include data from persons under the age of eighteen will be managed as follows.

  • Only a parent or legal guardian can include the MyDependentTracker product in their POIST Systems product purchases for persons under the age of eighteen.
  • Once a parent’s personal account has been established along with the MyDependentTrack product, the child's (dependent’s) account is treated much like any other account.
  • Only the parent or guardian listed as the account subscriber can access, add, change, or delete the dependent person’s personal data.
  • The parent or legal guardian can authorize a dependent’s Emergency Data Sheet link, providing access to important contact and medical information. Data used for the First Responder’s emergency medical data sheet should be carefully scrutinized by the parent or legal guardian before activation.

Upon a dependent child reaching the age of eighteen, the child can establish their own personal POIST Systems account. All data in the child’s MyDependentTracker program can be transferred to the new personal MyMediTracker account by contacting a POIST Systems LLC representative or requesting a file transfer via our contact page. POIST Systems LLC will send you a change document to fill out and have notarized prior to file transfers.

POIST Systems™ Document Updates

POIST Systems LLC reserves the right to update and modify this Privacy Statement at any time without notice to you. The most current version of the Privacy Statement can be reviewed by clicking on the hyperlink located at the bottom of our webpages. When we make updates to the Privacy Statement, POIST Systems LLC will update the date at the bottom of the page. By using the POIST Systems LLC website or any of its apps after a new version of the TOU has been posted, you agree to the terms of the new version.
